1. Acceptance of These Terms
By accessing, browsing, or using Smopper (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use Smopper, including use of our website, price comparison tools, store finder, saved baskets, and any related features.
2. Description of the Service
Smopper provides tools and information to help you compare grocery prices across stores. Our service includes search and comparison of prices (often normalized to unit price, e.g. per ounce or per unit), viewing of promotions and deals, store locators and maps, and the ability to save baskets or lists when you have an account.
Pricing, product availability, promotions, store locations, and other data displayed in Smopper are sourced from third-party providers, public information, or automated systems. This information may be delayed, incomplete, or inaccurate. We work to keep data current but do not guarantee that any price or promotion shown matches what you will see in-store or on a retailer's website at the time of your visit.
The compare tool is intended for informational use to help you make better shopping decisions. It is not a substitute for checking final price and availability at the store or at checkout.
3. No Retailer Affiliation or Guarantees
Smopper is not affiliated with, endorsed by, or sponsored by any grocery retailer unless explicitly stated. All retailer names, trademarks, and logos are the property of their respective owners. We use them only to identify stores and to describe the services we compare.
Prices and promotions shown in Smopper are for informational purposes only. Final prices, availability, and terms are determined by the retailer at the time of purchase. We do not set or control retailer prices, promotions, or policies. Discrepancies between what Smopper shows and what you see in-store can occur due to timing, location, or differences in how retailers present their data.
4. User Accounts and Saved Data
Smopper may allow you to create an account, save preferences, build shopping lists or baskets, and store other information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
We do not guarantee that saved data (e.g., saved baskets or lists) will be retained indefinitely or that it will be error-free. Smopper is not responsible for lost, deleted, or corrupted user data, whether due to technical failure, policy change, or any other reason. We recommend that you do not rely solely on Smopper for the only copy of important information.
5. Acceptable Use
You agree not to misuse the Service. Prohibited conduct includes, but is not limited to:
- Attempting to scrape, crawl, or automate access to Smopper in a way that burdens our systems or violates our technical or legal requirements.
- Reverse engineering, copying, or attempting to extract source code, data, or business logic from the Service.
- Interfering with the Service's operation, security, or the experience of other users.
- Using the Service for any unlawful purpose or in violation of applicable laws.
- Impersonating Smopper, our team, or another user, or misrepresenting your affiliation with us.
We may suspend or terminate access for anyone who we reasonably believe has violated these Terms or engaged in harmful conduct.
6. Third-Party Services and Content
Smopper relies on or integrates with third-party services, including grocery retailers (for pricing and product data), mapping and geolocation providers, analytics and advertising services, authentication providers, and hosting or infrastructure platforms. Your use of those services may be subject to their own terms and privacy policies.
Smopper is not responsible for the availability, accuracy, or content of third-party services. If a retailer or other partner changes or discontinues data or access, our ability to show that information may be affected.
7. Geolocation and Maps
Smopper may use location data to show nearby stores, tailor comparison results to your area, or improve the relevance of the store finder. Location data may be provided by your device, your input (e.g., address or ZIP code), or third-party mapping services. Location information can be inaccurate due to device settings, network issues, or mapping data errors.
You are responsible for verifying store locations, hours, and travel details before visiting. We do not guarantee that store information shown in Smopper is current or complete.
8. Disclaimer of Warranties
The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Smopper does not warrant that the Service will be uninterrupted, error-free, secure, or fully accurate. We do not warrant that prices, availability, or other data will match what you find at any retailer. You use the Service at your own risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Smopper and its operators, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes damages for loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim, or one hundred United States dollars ($100), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability will be limited to the maximum extent permitted by law.
10. Termination
Smopper may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud or abuse, or for operational or legal reasons. Upon termination, your right to use the Service ceases immediately.
You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.
11. Changes to the Service or Terms
Smopper may modify or discontinue the Service, or any part of it, at any time. We may also update these Terms from time to time. We will post the current Terms on this page and update the "Last updated" date when we make material changes. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you should stop using the Service.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the applicable laws of your state of residence, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts of the United States or your state, as applicable.
